Family Dispute Over the Ambassadeur Hotel

Following the death of Samuel Maina, a legal dispute emerged among family members over the control of the business empire.

In January 2017, four brothers, Francis Chege, Joseph Macharia, James Kihara, and Dedan Muthaiga, filed a lawsuit against their siblings John Kaguma, Stanley Kariuki, and Charles Kanyunga. The petitioners accused their brothers of taking exclusive control of family businesses and excluding them from the profits.

One major issue raised in the case involved the appointment of Paragon Property Consultants to collect rent from family properties without the consent of all stakeholders. As a result, a 2012 court order appointed Lloyd Masika Limited to manage the nine businesses under dispute until the matter could be resolved.

Under the court arrangement, all rental income from the properties is deposited into a joint bank account supervised by representatives from both sides and Lloyd Masika.

The dispute added another layer to the legal battle surrounding the family’s multi-billion-shilling property portfolio. To break the stalemate, the court appointed Joseph Mutava to select a property manager from a list proposed by the family members after they failed to agree on one.
